NASCAR Euro Series, confermate le sanzioni ad ALUMITEC dopo Brands Hatch

Sintesi della decisione

Il Tribunale Nazionale d’Appello della Federazione Francese (TAN) ha confermato integralmente le misure adottate dal Panel of Stewards in occasione del NASCAR GP UK a Brands Hatch. In particolare, il TAN:

• DECLARES the appeal lodged by the appellant is admissible;
• UPHOLDS in their entirety: Decisions No. 09 and No. 10 of the Panel of Stewards dated 7 June 2026;
• ORDERS that the appeal deposit be retained in full by the FFSA in accordance with Article 5 of the “National Appeal Tribunal” Regulations;

Il TAN richiama espressamente alcune norme rilevanti per la vicenda. Tra queste figurano, testualmente, le disposizioni delle regolamentazioni della NASCAR Euro Series e dell’ISC citate nel documento:

Article 19 of the NASCAR Euro Series Technical Regulations: “Technical inspections may be carried out at any time by the Technical Delegate and/or NES officials, who may be assisted by TEAM FJ technicians. Technical inspections shall be carried out at the location specified by TEAM FJ in the technical and sporting notes published for each event.”

Article 20 of the aforementioned Regulations: “Any refusal to submit to a technical inspection and/or check shall be considered as a non-conformity of the vehicle and shall be referred to the Panel of Stewards.”

Article 11.7.1.a of the ISC: “The Stewards appointed for an Event shall have absolute authority to enforce the Code, the FIA regulations where applicable, the national regulations, and the Supplementary Regulations, as well as the Official Programmes, within the framework of the Event for which they are appointed (…)”

Article 12.2.1.i of the ISC: “Any of the following offenses or infringements, in addition to those specifically referred to above or below, shall be deemed to constitute a breach of these rules: (…) Any failure to comply with the obligation to follow the instructions of the relevant officials for the safe and orderly conduct of the event.”

Fatti esaminati e conclusioni

Nel corso dell’istruttoria (punti 36-39) il TAN registra che l’Appellante non contesta di aver opposto resistenza all’ispezione tecnica richiesta dal tecnico scrutatore relativa al motore. L’opposizione era motivata dall’Appellante con obblighi connessi all’ATA Carnet.

Il TAN osserva inoltre che non è stata prodotta prova che il motore danneggiato sarebbe stato rimosso per un periodo tale da imporre al Team ALUMITEC RACING di rientrare in Francia senza il motore medesimo, alla luce degli obblighi dell’ATA Carnet.

Valutando le prove e le testimonianze, il Tribunale ritiene insufficienti i documenti e le spiegazioni forniti per giustificare un rifiuto all’ispezione tecnica. Ribadisce, inoltre, la piena autorità dei Commissari e dei delegati tecnici a svolgere le verifiche ritenute necessarie durante gli eventi.

Esito

In virtù delle considerazioni sopra descritte, il TAN conclude che le Decisions No. 09 and No. 10 of the Panel of Stewards, emesse il 7 giugno 2026, devono essere confermate senza modifiche.
